Diner Terms of Use

1. What Ding! Provides

Ding! provides software that restaurants use to offer AI-powered features to their diners, including a Waiter Agent (an AI menu assistant), AI-generated menu information and recommendations, and the ability to leave reviews on menu items.

Ding! provides these features on behalf of the restaurant you are interacting with. The restaurant — not Ding! — is responsible for its menu, prices, ingredients, allergen handling, food preparation, and the operation of its business.

2. The Assistant Uses AI and Can Make Mistakes

The Waiter Agent and other assistant features use artificial intelligence. AI responses can be inaccurate, incomplete, or out of date. Information provided through these features — including prices, ingredients, nutrition, hours, and availability — is for general guidance only and is not a guarantee.

You should confirm anything important directly with the restaurant before relying on it. Do not rely solely on the assistant for decisions that matter to you.

3. Allergen, Dietary, and Health Information

Allergen and dietary information provided through Ding! is AI-generated from the restaurant's menu and may be incomplete or inaccurate. It is a guide only and is not a substitute for confirming directly with restaurant staff. Food is prepared in shared kitchens, and we cannot guarantee that any item is free from any allergen or from cross-contact.

If you have a food allergy or dietary restriction, always tell a member of restaurant staff before ordering. The assistant does not provide medical, dietary, or allergy advice, and nothing it says should be treated as such.

4. Reviews and Content You Submit

If you submit a review or other content, you agree that it is your own honest opinion or experience, is not false, misleading, unlawful, defamatory, harassing, or infringing, and does not contain another person's private information.

You grant Ding! and the relevant restaurant a non-exclusive, royalty-free, worldwide license to display, store, and use the content you submit in connection with operating the platform and the restaurant's presence on it.

We may remove content that violates these Diner Terms, and we use device identifiers and rate limiting to prevent spam and abuse, as described in our Privacy Policy.

5. Acceptable Use

You agree not to misuse the platform, including by attempting to disrupt or reverse-engineer it, submitting malicious content, scraping or harvesting data, impersonating others, or using the features for any unlawful purpose.

6. Privacy

Our Privacy Policy explains what information we collect when you use these features, how we use it, who we share it with (including the restaurant you are interacting with and our sub-processors), and the choices and rights available to you.

7. Disclaimers and Limitation of Liability

The features are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, merchantability, or fitness for a particular purpose, to the maximum extent permitted by law.

To the maximum extent permitted by applicable law, Ding! is not liable for any actions or omissions of restaurant staff, inaccuracies in menus or allergen information provided by a restaurant, or any claim arising from your reliance on AI-generated information. Nothing in these Diner Terms limits any liability that cannot be limited under applicable law.

8. Changes to These Terms

We may update these Diner Terms from time to time. Changes take effect when posted on this page, and the "Effective Date" above will be updated. Your continued use of the features after changes take effect constitutes acceptance.
